1. Acceptance of Terms

By accessing, browsing, or using VisaIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must immediately cease using the Service. Creating an account, submitting a query, or continuing to use the Service after any update constitutes acceptance of the current Terms.

These Terms constitute the entire agreement between you and Pratibha Mamgain (ABN 46 570 430 015) ("we", "us", "our", "Operator") in relation to your use of the Service and supersede all prior representations, agreements, or understandings.

VisaIQ is intended for users aged 18 and over. By accepting these Terms you confirm you are at least 18 years of age.

2. Nature of the Service — Information Only

VisaIQ is an AI-powered research and information tool only. It assists users in:

• Identifying potentially relevant ANZSCO occupation codes based on job titles and duties
• Exploring possible skilled migration visa pathways to research (subclasses 189, 190, 491, 482, 186)
• Reviewing historical invitation round data and indicative points estimates
• Understanding skills assessment authority requirements and evidence standards
• Identifying potential evidence gaps to discuss with a registered migration agent

Any examples, sample outcomes, points estimates, pathway descriptions, or case studies shown on the website or within the Service are illustrative only and do not guarantee similar outcomes for any individual.

2A. Assessment Requirements Data — Indicative Only

The Service displays information about skills assessing authority requirements, including fee amounts, processing times, document checklists, application steps, English language requirements, and pathway descriptions. You acknowledge and agree that:

• This data is sourced from publicly available research and is not provided by, endorsed by, or verified by any assessing authority
• Fee amounts, processing times, and requirements change frequently and without notice — the data shown may be out of date at the time you access it
• You must verify all requirements directly with the relevant assessing authority (e.g., ACS, ANMAC, Engineers Australia, VETASSESS, AMC) before submitting any application or making any payment
• The Operator accepts no liability for any loss, cost, or adverse outcome arising from reliance on assessment data shown in the Service without independent verification
• Processing time estimates are indicative averages only and do not represent any guarantee or commitment by any assessing authority

2B. ANZSCO Classification — Indicative Only

ANZSCO occupation code classifications produced by the Service are AI-generated estimates only. The Operator makes no representation that any classification produced by the Service is:

• The classification that would be assigned by an assessing authority, the Department of Home Affairs, or any other official body
• Consistent with how the same job title or duty description may be classified in a different query, at a different time, or by a different AI model
• Appropriate for inclusion in a visa application, Expression of Interest, or skills assessment submission without verification

ANZSCO classification decisions made by assessing authorities are independent of any classification suggested by this Service. A classification produced by this Service should be used only as a starting point for discussion with a registered MARA agent, not as a final determination.

3. User Accounts

To use VisaIQ, you must create an account using a valid email address. We use a passwordless "magic link" authentication system. You are responsible for:

• Maintaining the security of your email account, which is the sole key to your VisaIQ account
• All activity that occurs under your VisaIQ account, whether authorised by you or not
• Ensuring the email address you provide is accurate, current, and accessible
• Notifying us immediately if you suspect unauthorised access to your account

You must not share your account or allow others to use your login links. Accounts are personal and non-transferable. We reserve the right to terminate accounts where we become aware the user is under 18.

4. Free and Paid Tiers

VisaIQ operates a freemium model:

• Free tier: 5 occupation analyses at no cost, provided as-is with no guarantee of continued availability.
• Pro tier: High-volume access to analyses and all Pro features, available by paid subscription. Pricing is displayed at the point of purchase. Pro tier access is subject to a reasonable fair use policy designed to prevent automated abuse, excessive API consumption, service degradation, or use outside normal individual human behaviour. We may apply temporary rate limits where usage materially exceeds ordinary human use patterns.

Free tier usage limits are tracked per account. Circumventing usage limits (including by creating multiple accounts) is a material breach of these Terms and may result in immediate account termination. We may modify free tier limits, pricing, and available features from time to time. Changes to paid subscription pricing will apply from the next billing period unless otherwise stated at the time of change or required by law.

Refunds: Except where required under the Australian Consumer Law or other applicable law, subscription fees are generally non-refundable once payment has been processed, because the Service provides immediate access to digital functionality and incurs third-party AI processing costs. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded. Availability: We do not guarantee uninterrupted, error-free, or continuous availability of the Service. Features may be changed, suspended, rate-limited, or discontinued where reasonably necessary, including due to third-party AI provider outages.

5. No Migration Agent Relationship

Use of VisaIQ does not create, and shall not be construed as creating, a client-agent relationship, a solicitor-client relationship, or any professional advisory relationship of any kind. The Operator is not registered with the Office of the Migration Agents Registration Authority (OMARA) and is not authorised to give migration advice under the Migration Act 1958 (Cth). For formal migration or legal advice, you must engage a registered MARA agent or qualified legal practitioner.

Use by registered migration agents: If you are a registered MARA agent using this Service to assist with client work, you remain solely responsible for verifying all outputs against official sources and for all advice given to your clients. The Service does not remove or reduce your professional obligations under the MARA Code of Conduct. You must not represent to clients that any output of this Service constitutes a formal skills assessment outcome, an official ANZSCO classification, or a Department of Home Affairs determination.

6. No Emergency or Deadline Reliance

The Service must not be used as the sole basis for time-sensitive immigration decisions, visa lodgements, skills assessment submissions, appeals, reviews, or deadlines. The Service is not designed for use in merits review, judicial review, tribunal proceedings, ministerial intervention requests, visa refusal responses, or legal submissions. You must not rely solely on Service outputs for decisions to accept or reject employment, education, relocation, or migration opportunities. Always verify information with official sources before taking any action.

Output variability: Because the Service uses AI inference, outputs may differ between sessions even where the same or similar inputs are provided. You must not treat any single output as definitive or assume that a subsequent query will produce the same result. You should not rely on a single output without corroborating it against other sources or professional advice.

7. User Responsibility for Official Sources

You are solely responsible for checking all information produced by the Service against official sources, including:

• The Department of Home Affairs (homeaffairs.gov.au)
• The relevant state or territory nomination body
• The relevant skills assessment authority
• A registered MARA agent or qualified legal practitioner

Immigration law, occupation lists, invitation rounds, and assessing body requirements change frequently. We make no warranty that any output of the Service is current, accurate, or complete at the time you access it.

8. Acceptable Use

You must not use the Service to:

• Submit fraudulent, misleading, or unlawful information
• Attempt to bypass, circumvent, or undermine usage limits or security measures
• Scrape, copy, reproduce, or redistribute Service outputs commercially without prior written permission
• Submit content that violates any applicable law or third-party rights
• Impersonate any person or organisation
• Attempt to reverse-engineer, decompile, or access any underlying systems or data
• Transmit malware, viruses, or any harmful code
• Use automated tools (bots, scrapers, scripts) to access the Service

9. Account Termination

We may suspend or terminate your account where we reasonably believe you have breached these Terms, abused the Service, created multiple accounts to circumvent limits, created a security or legal risk, or engaged in conduct harmful to the Service or other users. Where reasonably practicable, we will provide notice before suspension or termination. We may act without notice where necessary to protect the Service, other users, or legal compliance. You may request deletion of your account and associated data by emailing hello@visaiq.tech.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pratibha Mamgain (ABN 46 570 430 015), her officers, employees, agents, and successors against losses, claims, costs, and expenses (including reasonable legal fees) arising from:

• Your breach of these Terms
• Your unlawful or unauthorised use of the Service
• Your submission of false, misleading, infringing, or unauthorised content
• Your misuse of Service outputs contrary to the disclaimers and limitations stated in these Terms
• Your violation of any applicable law or third-party right

11. Third-Party AI Services

VisaIQ uses Anthropic Claude and Google Gemini for AI inference. Content you submit is transmitted to these services for processing and is subject to their respective terms and privacy policies. The Operator is not responsible for the outputs, accuracy, availability, or conduct of these third-party AI services. You acknowledge that you are interacting with an AI system and that AI outputs are not infallible.

12. Limitation of Liability

To the fullest extent permitted by Australian law:

• No consequential loss: The Operator is not liable for any indirect, incidental, special, consequential, or punitive loss or damage of any kind, including loss of profits, loss of revenue, loss of data, loss of opportunity, visa refusals, delays, adverse immigration outcomes, or any other consequential loss, whether arising in contract, tort (including negligence), statute, or otherwise, even if advised of the possibility of such loss.
• Liability cap: To the extent any liability cannot be excluded at law, the Operator's total aggregate liability to you for any claim arising out of or relating to the Service or these Terms is limited to the total amount paid by you to the Operator in the 3 months preceding the event giving rise to the claim, or AUD $50 (whichever is greater).
• No warranty: The Service is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• Consumer law: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) where it would be unlawful to do so. Where a guarantee applies that cannot be excluded, the Operator's liability is limited, to the extent permitted by law, to re-supplying the services or paying the cost of having the services re-supplied.

13. Force Majeure

The Operator is not liable for any failure or delay in performing obligations under these Terms arising from circumstances beyond the Operator's reasonable control, including acts of God, government action, internet outages, third-party service failures (including AI provider outages), or changes in immigration law or policy.

14. Intellectual Property

All content, software, design, and materials of VisaIQ are the property of Pratibha Mamgain (ABN 46 570 430 015) or the Operator's licensors. ANZSCO data is sourced from the Australian Bureau of Statistics and the Department of Home Affairs and remains the property of the Commonwealth of Australia. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without prior written consent.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We may update these Terms at any time by posting the revised version on this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. Where changes are material, we will endeavour to notify registered users by email.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising out of or relating to these Terms or the Service. If you are accessing the Service from outside Australia, you do so at your own risk and are responsible for compliance with local laws.
