1. Acceptance of Terms

By accessing or using VisaIQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Creating an account constitutes acceptance of these Terms.

2. Nature of the Service

VisaIQ is an AI-powered research and intelligence tool that assists users in:

• Identifying potentially relevant ANZSCO occupation codes based on job titles and duties
• Exploring skilled migration visa pathways (subclasses 189, 190, 491, 482, 186)
• Reviewing historical invitation round data and points estimates
• Understanding skills assessment authority requirements and evidence standards
• Analysing reference letters and statutory declarations for assessment readiness

The Service does not constitute migration advice, legal advice, a skills assessment, or a visa application. It is an informational research tool only.

3. User Accounts

To use VisaIQ, you must create an account using a valid email address. We use a passwordless "magic link" authentication system — a one-time login link is sent to your email address each time you sign in.

You are responsible for:

• Maintaining the security of access to your email account
• All activity that occurs under your VisaIQ account
• Ensuring the email address you provide is accurate and accessible

You must not share your account or allow others to use your login links.

4. Free and Paid Tiers

VisaIQ operates a freemium model:

• Free tier: 5 occupation analyses at no cost. Free tier analyses are provided as-is with no guarantees of availability or continued access.
• Pro tier: Unlimited analyses and access to all features, available by paid subscription. Pricing is displayed at the point of purchase.

Free tier usage limits are tracked per account. Circumventing usage limits (including by creating multiple accounts) is prohibited.

We reserve the right to modify free tier limits, pricing, and available features at any time with reasonable notice.

5. Reference Letter Validator

The Reference Letter Validator feature allows you to submit reference letter or statutory declaration text for AI-powered analysis. By using this feature:

• You confirm you have the right to submit the document content (e.g., consent from the candidate or employer)
• You acknowledge that the submitted text is sent to Anthropic Claude for analysis (see Section 10)
• You understand the analysis is indicative only and does not guarantee assessment outcomes

Do not submit documents containing sensitive personal information (such as passport numbers, tax file numbers, or financial details) beyond what is necessary for duty analysis.

6. No Migration Agent Relationship

Use of VisaIQ does not create a client-agent relationship. VisaIQ is not registered with the Office of the Migration Agents Registration Authority (OMARA). For formal migration advice, engage a registered MARA agent or qualified legal practitioner.

7. Accuracy of Information

While we strive to keep information current, we make no warranties that:

• ANZSCO matches accurately reflect your occupation classification
• Points estimates reflect your actual points entitlement
• Invitation round data is current or complete
• Occupation list eligibility for any state is up to date
• Reference letter analysis reflects the actual assessment body's decision

Immigration law and policy change frequently. Always verify information with the Department of Home Affairs and a registered MARA agent before taking any action.

8. Acceptable Use

You must not use the Service to:

• Submit fraudulent or misleading information
• Attempt to bypass usage limits or security measures
• Scrape, copy, or redistribute Service outputs commercially without permission
• Submit content that violates any applicable law
• Impersonate any person or organisation

9. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, abuse the free tier, or engage in activity that places undue load on our systems. You may request deletion of your account and associated data by emailing hello@visaiq.tech.

10. Third-Party AI Services

VisaIQ uses Anthropic Claude and Google Gemini for AI inference. Content you submit (job titles, duty descriptions, reference letter text) is transmitted to these services for processing and is subject to their respective terms and privacy policies. We do not sell or share your data with these providers beyond what is necessary to deliver the Service.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Pratibha Mamgain and VisaIQ are not liable for any loss or damage arising from:

• Reliance on information provided by the Service
• Visa refusals, delays, or adverse immigration outcomes
• Errors or omissions in ANZSCO matching, points calculations, or reference letter analysis
• Interruption or unavailability of the Service
• Unauthorised access to your account

12. Intellectual Property

All content, software, and design of VisaIQ is the property of Pratibha Mamgain. ANZSCO data is sourced from the Australian Bureau of Statistics and the Department of Home Affairs and remains the property of the Commonwealth of Australia.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated by email where possible.

14. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
